Education Sector Staff Transfer Scheme published for consultation
The Education Sector Staff Transfer Scheme developed and agreed with Trade Union Side and employers has now been subject to equality screening in accordance with the Department of Education (DE) Equality Scheme.
The purpose of the Staff Transfer Scheme is to set out arrangements for the transfer of staff from the Education Sector RPA affected organisations into the Education and Skills Authority (ESA). The scheme excludes DE staff who will be subject to a separate transfer scheme. The scheme is made in accordance with the Transfer of Undertakings (Protection of Employment) (TUPE) Regulations 2006, relevant legislation and PSC Guiding Principles and confirms that existing contractual terms and conditions of employment including pension arrangements and continuity of employment will be protected on transfer to ESA.
The decision of the screening is that the scheme is screened out. The basis for this decision is that the scheme provides for all staff across the affected organsiations (excluding DE) the equal right of transfer to ESA with their contractual terms and conditions of employment together with pension arrangements and continuity of employment protected.
